PROPOSED RULE 445. WOOD BURNING APPLIANCES

(6) LOW EMISSION FIREPLACE means a wood burning fireplace that meets the criteria established by the U.S. EPA as part of the Voluntary Low Emission Fireplace program.

(d) Requirements

    (1) Effective (twelve months following rule adoption), no person shall sell, offer for sale, supply, or install, a new wood burning appliance or gaseous-fueled hearth appliance unless it meets one of the following criteria:
    (A) A U.S. EPA Phase II-Certified wood burning heater;
    (B) A pellet-fueled wood burning heater;
    (C) A masonry heater; or
    (D) A low emission fireplace; or
    (E) A dedicated gaseous-fueled fireplace.
